DECISION OF THE
ZONING BOA1W OF APPEALS

At its meeting on Wednesday, August 9, 1978, the Zoning Board
of Appeals for the City of Northampton voted to & ant the petition
of Charles N. Miller for a variance to construct a single family
home on a lot on Ryan Road which has insufficient frontage under
the Northampton 'Zoning Ordinance.
Based upon evidence presented to the Board, the Board made
the following findings in regard to the variance:
1. The property in its present form is unique and has prob-
lems affecting it and no other in the Zoning District in that
it is a key lot which, although it is a large lot, has front-
age fifteen (15 ) feet short of that required by the Zoning
Ordinance.
2. The literal enforcement of the Zoning Ordinance would in-
volve substantial hardship to the owner in that it would deny
him a reasonable use of his property and would result in the
loss of construction services by Smith' s School.
3. The proposed use will not be detrimental to the public
good in that the parcel has passed the percolation test,public
facilities will not be overloaded and the home will conform to
others in the vicinity.
4. The proposed use will not nullify or derogate the intent
of the Zoning Ordinance because residential uses are allowed
in a Suburban Residential Zone.
The variance is granted, subject to the limitation that con-
struction conform to the plan submitted to the Zoning Board of
Appeals.
