Melnik Building Permit Owner/Applications Haydenville Road(Map 06 Parcel 061)& Evergreen Road opposite Chestnut Avenue 636 Associates Construction Management Inc at 3 lots on or abutting 320 Turkey Hill Road Dear Mr.Patillo, After learning of construction that may constitute a public water system on Haydenville Road, Massachusetts Department of Environmental Protection(MassDEP) staff reviewed files in the Northampton building,planning and health offices. As a result of that review,MassDEP staff identified proposed facilities that appear to meet the definition of a Public Water System and require MassDEP prior approval under 310 CMR 22.00, before construction of the facilities, including the buildings. MassDEP Drinking Water regulations define a public water system as a system that regularly serves twenty-five (25)or more persons for sixty (60)days per year. Facilities with thirteen or more bedrooms exceed this threshold. The combined bedrooms and wells on common property are counted together to identify the total bedrooms of a facility. Mass DEP staff review indicates that the proposed condominium on Haydenville Road would contain sixteen(16) bedrooms, If served by a common well or wells on commonly owned property,the proposed subdivision on Evergreen Road would likely exceed the threshold as well. Also, a Turkey Hill Road condominium proposal for three buildings, each with nine(9)bedrooms, for a total of twenty-seven(27)bedrooms,exceeds the threshold. Until such time as the owners and/or applicants resolve these issues through compliance with all Public Water System requirements,or Mass DEP determines that the project does not meet the definition of a Public Water System,MassDEP requests that no further building permits be issued.
