Northampton Planning Board July 14, 1988 Meeting The Northampton Planning Board met on July 13, 1988 in Council Chambers, Wallace J. Puchalski Municipal Building to continue the Public Hearing on the Application of Christensen-Howard, Inc. for a Special Permit under the Provisions of Section 6.12 of the Northampton Zoning Ordinance to allow construction of a common driveway across a wetland to serve seven building lots off Turkey Hill Rd. Present and voting were Chair Nancy Duseau, A. Crystal, M. Mendelson, J. Arnould, E. J. Gare III, J. Beauregard and J. - Hale. At the June 23rd meeting, the unresolved issue was the Fire Department's request that the bridge be capable of supporting 18 tons, and the common driveway support 25 tons. Peter Wells of Berkshire Design Group presented a letter dated June 28, 1988 from Fire Chief Driscoll, stating that the developers ' plans are accgptable to the Northampton Fire Department and comply with their regulations. Mr. Wells pointed out that the bridge will support 20,000# per axle, and the road will support 25 tons. Ch. Duseau closed the Public Hearing. E. J. Gare moved to grant the Special Permit since the criteria are met, and J. Beauregard( seconded. Mr. Smith added eight conditions, which will be made a part of the Decision filed with the City Clerk. Mr. Brooks ' request that "House numbers be put on the houses" was ignored. Restrictions shall be placed on the deeds to the ' 1 subject lots: i a. prohibiting any additional vehicular access to said lots- from other than the common driveway approved by this Special Permit. b. stating that said common driveway is a private driveway and is not a city way. The maintenance, operation, repair, and reconstruction ( including snow plowing and snow/ice removal) is the responsibility and liability of the property owners. 5. Sufficient ' documentation and deed restrictions (homeowners ' association, etc. ) shall be developed regarding the management, maintenance, repair and reconstruction of the common driveway, bridge, and "dry hydrants. " 6. All plans and easements must be amended to reflect those changes required by the Northampton Conservation Commission. 7. All work shall conform to any Order of Conditions issued by the Conservation Commission, and said conditions shall be considered a part of this Special Permit. 8. All deed easements, easement plans, restrictions and homeowners ' association documentation must be submitted to and approved by the Northampton Department of Public Works and the City Solicitor' s Office prior to their recording and prior to the issuance of any Building Permits. The Findings were: as follows: The requested use requires a Special Permit under the Provisions of Section 6.12 of the Zoning Ordinance. The requested use bears a positive relationship to the public welfare, in that it will reduce the number of individual crossings of a wetland from seven to one. The requested use will not create undue traffic congestion or unduly impair pedestrian safety. The requested use will not overload any municipal systems. The bridge and roadway meet all the requirements of the Northampton Fire Department. The requested use will not unduly impair the integrity or character of the district, and is in harmony with the general purpose and intent of the Ordinance. THE FOLLOWING CONDITIONS SHALL APPLY: 1. House numbers, identifying all of the homes utilizing the . common driveway, shall be placed at its intersection with Turkey Hill Road and at the intersecting "T" of the common driveway, sufficient for identification by emergency vehicles. 2. In making this decision, the Planning Board found: a) . The common driveway shall not service more than (3) lots and shall only provide vehicular access to the lots shown on the revised plans dated January 27 , 1994 . b) . The common driveway provides the only vehicular egress/access to the lots being serviced by it and shall be so stated in the deeds to the subject lots as it is required by the Planning Board. c) . The grades, length and location of the common driveway as presented is of suitable construction, in the opinion of the Planning Board, for the access and turn-around of the number and types of vehicles, including moving vans, ambulances, fire and police, which will be utilizing such driveway. In Reviewing the Plans presented with the application for a Common Driveway Special Permit, The Planning Board found: 1. The driveway does have a width of at least fifteen (15) feet. 2 . The driveway does have passing turnouts providing a total width of at least 20 feet. along a distance of at least twenty-five (25) feet that are not spaced more than 300 feet between turnouts, and the first such passing turnout is located at the driveway connection to the street. 3 . The driveway did meet the prior approval of the DPW and the Fire Department. 4 .
