The Planning Board approved the access to the property over the side lot line based on the following plans and information submitted
with the application
1. Conservation Restriction Plan of Land,Prepared for Robert J. Walker and Stephen D.Ross by Harold L. Eaton Associates,Inc.dated
March 29,2007.
The Board determined that the following site plan criteria had been met:
1. The requested use protects adjoining premises against seriously detrimental uses. The use of the property is allowed. The access is
over an existing driveway and will be improved to accommodate the use.
2. The requested use will not have an effect on convenience and safety of vehicular and pedestrian movement within the site and on
adjacent streets,roads in the area.
3. The requested use will have no effect on the relationship of structures and open spaces to the
natural landscape, existing buildings and other community assets in the area because the existing driveway and building will be used
with no expansion of the building footprint.
4. The requested use will not overload,and will mitigate adverse impacts on,the City's resources
including the effect on the City's water supply and distribution system,sanitary and storm
sewage collection and treatment systems,fire protection,streets and schools. The parcel will remain in agricultural use and there will
not be any increase in impervious cover.
6.Compliance with the following technical performance standards:
A. Curb cuts onto streets shall not be changed.
B.Pedestrian,bicycle and vehicular traffic movement will not be affected.

FINDINGS:
The Zoning Board denied the appeal by the applicant and thus upheld the Building Commissioner's interpretation that this lot qualifies as
a building lot based on the plans and materials submitted with the application.
1. Conservation Restriction Plan of Land,prepared for Robert L. Walker and Stephen D.Ross,prepared by Harold L.Eaton Associates,
Inc. dated March 29, 2007.
2.Legal Opinion for 32C-319, addressed to Floyd Andrus, written by Lyon&Fitzpatrick,LLP.Dated December 30,2005.
In upholding the Building Commissioner's determination,the Board found based on the evidence and information presented at the
' hearing that Ventures Field Road,is an elevated road, qualifying as"frontage", leading up to the flood control dike,but is not the dike
itself. The Board also determined that the frontage is illusory because of the elevation change from the paved way to the edge of the
right-of-way. However, the Board also determined that this could be corrected by access from the side lot via another public way
(Montview Avenue) if the allowable and necessary permits are obtained from the Northampton Planning Board.
