Paquette , 25 Henry Street Northampton, DIass. 01060 Re: Fill at 25 Henry Street Dear Mr. Paquette: Recently the Northampton Conservation Commission received a cm plaint that you have been bringing fill into your property at 25 Henry Street and were progressively filling in a wetland to the rear of the lot. At their meeting on January 25, 1982 the Ccmni.ssion determined that the placing of fill on this portion of your lot (also identified as Parcel 311 on Sheet 32C of the Northampton Assessor's Maps) is "altering" and "filling" of a "fresh-water wetland" area bordering cn a "creek", "stream", "pond" or "land subject to flooding" as defined in the Regulations Under the Wetland Protection Act, General Laws Chapter 131, 5ectiot1 40, and as such you are requested to cease and desist from the placing of any more fill in this area. Should you desire to continue filling in this area you must first file a Notice of Intent with the Conservation Ccinnission, copies of which are avail- able in this office, after which the Cccnnission will hold a public hearing and issue an Order of Conditions. Paquette D_ 25 Henry Street February 23, 1982 Northampton, Massachusetts 01006 S,_TF: & ACT_I Y I TY: The placing of fill and construction of a 64'x 42' structure to the rear of your property at 25 Henry Street (also identified as parcel 311 on sheet 32C of the Northampton Assessor's Maps), in an area already identified in the Northampton Conservation Commiss'ion's letter to you dated January 28, 1982 (a copy of which I�have enclosed) as a "freshwater wetland ' area bordering on a "creek", 11 if stream , pond or land subject to flooding' is indeed filling and altering as defined and regulated by the Regulations Under the Wetlands Protection Act, General Laws chapter 131, Section 40. The Conservation Commission, duly appointed under Chapter 40 Section 8C, G.L. , has investigated the site and activity as above described. It has determined that the said activity is in violation of Chapter 131 Section 40, G.L. , and accordingly orders the following: 1 . The person in posession of the property, his agents and permittees, and all other persons shall forthwith cease and desist from further activity affecting the vetland portion of the site. 2. fork performed in violation of the Act or of any Order issued thereunder shall be corrected and the site returned to its original condition. 3. kequired form and plans as listed in the Regulations under the Act shall be filed with the Commission, and no further work shall be performed until a public hearing has been hgld� and an Order of Conditions issued to regulate the said work. 4. Smith,Planner SUBJECT: Request Revocation of Building Permit Issued to Charles J. Paquette DATE: February 23, 1982 FILE: Enclosed please find a letter from myself to Mr. Charles J. Paquette of 25 Henry Strett:, Northampton dated January 28, 1982 in which the Northampton Conservation requested that he cease and desist from filling a fresh water wetland area subject to flooding to the rear of his property. Also enclosed please find a copy of a Cease & Desist Order dated February 23, 1982 issued by myself on behalf of the Northampton Conservation Commission ordering Mr. Paquette to stop filling in this area,and,as well,to cease construction of a 64'x 42' structure on this fill, and further.ordering that no work may commence until an Order of Conditions has been issued. I hereby, on behalf of the Northampton Conservation Commission, respectfully request that you revoke the Building Permit issued to Mr. Paquette for the construction of the above mentioned 64'x 42' structure until such time as he has received all applicable permits from the Conservation Commission. cc: City Solicitor
