Executive Office of Human Services Department of Public Health Determination of Need Program 150 Tremont St. Boston, Mass. 02111 Dear Mr. O'Donnell : We have received a letter from Mr. Mark Richmond, Director of Marketing and Planning, at the Cooley Dickinson Hospital , regarding addition and renovations at the hospital . The hospital is located in Urban Residence "B" (URB) zone, resulting that the use and the structures are both non-conforming to our local zoning ordinance. There- fore, any renovations and additions must.be granted by the Zoning Board of Appeals. Article IX of the Zoning Ordinance explains the Non-Conforming Uses, Structures, and Lots. Section 9.3 - Pre-Existing Non-Conforming Structures or Uses may be changed, extended or altered. For the additions in our opinion, Section 9.3, Paragraph Al for a finding is required. For the use Section 9.3, Paragraph B for a finding is required. The time frame for a finding is approximately two and a half (2'12) months plus a twenty (20) day appeal period, from the time the decision of the ZBA is registered St the City Clerk's Office.
