Dear Sirs:
Councilor Tymocko has asked that our office investigate the allegations that there have
been illegal curb cuts that have been installed at your property at 123 Hawley Street and
that sidewalks have been paved over. Our office has no record of an Zoning application
requesting additional curb cuts. I asked the Department of Public Works to review their
records to determine if in fact additional curb cuts have been made.
Enclosed you will find the result of that search The records from DPW indicate that you
have installed a additional curb cut of 25' at your property without proper permits. You
are in violation of Northampton Zoning Ordinance 8.9 - 7 (copy of ordinance enclosed).
You have 60 days to correct the violation and restore the property to its previous
condition or file with the Northampton Planning board a request for a Special Permit to
allow the additional curb cut. You face fines of up to $100 per day and or court action if
you fail to take action after the 60 day lapses.
You have right of appeal and may start the process by filling a Zoning Request in this
office for a Special Permit with the Planning Board.
