06-041 Decision of Northampton PB August 22 1991DECISION OF NORTHAMPTON PLANNING BOARD At a meeting held on August 22, 1991, the Planning Board of the City of Northampton voted unanimously to GRANT the request of Robert A. Young and Mary A. Young for a Special Permit under the Provisions of Section 6.13 of the Northampton Zoning Ordinance to allow the creation of a flag lot at 291 Haydenville Road, more specifically Parcels 40 and 41 of Sheet 6 of the Northampton Assessors maps. Present and voting were Chairman J. Beauregard, A. Crystal, W. Larkin, D. Welter, M. Mendelson, and J. Hale. The Planning Board found: 1. The Plan submitted, described as: "Plan of land in Northampton, Massachusetts prepared for Robert A. and Mary A. Young by Richard J. LaBarge, Sr., PLS dated July 15, 1991, divides Parcels 40 and 41 of Sheet 6 into two lots, one of which is a three acre lot on which the applicants' dwelling now sits, and a flag lot of 12.638 acres. 2. Looking to the requirements and criteria of §6.13, the Board finds that the proposed flag lot has access frontage on Haydenville Road of fifty feet; that access width, from the front lot line to the proposed principal structure is fifty feet; the access roadway is perfectly straight; the flag lot '.. has at least 16 times the required lot area for the SR District; all setbacks are equal to at least two times the setbacks required for the SR District; the maximum building coverage will not exceed two - thirds of that normally permitted in the SR District; the minimum open space percentage is far more than the 85% required; and the requirement of §6.13(h) is adequately met. 3. Robert A. Young, 291 Haydenville Road, Leeds, MA 01053 to enter upon the 1918 State Highway Layout in the City of Northampton known as Route 9 or Haydenville Road for the purpose of constructing a residential access on the easterly side of the highway, DIG SAFE NUMBER, Prior to the start of any work under this permit, the Grantee shall notify the PUBLIC UTILITY UNDERGROUND PLANT DAMAGE PREVENTION SYSTEM (DIG SAFE) by calling 1- 800 -322- 4844. Upon issuance of the DIG SAFE NUMBER the grantee shall forward said number to the Massachusetts Department of Public Works District Highway Office by telephoning 1 413 -584 -1611, All shoulder areas, paved areas, grass areas, drainage lines and structures, curbing, edging, ([driveway and street crossings]) or other highway appurtenances that are disturbed due to the construction work shall be replaced and /or restored to its original condition. The District Highway Engineer shall be notified 24 hours in advance of any work by the Grantee. All described work shall be completed as directed by, and to the satisfaction of, the Engineer. All traffic control devices shall be as required by the Manual on Uniform Traffic Control Devices and shall be placed and replaced by the Grantee at the work site as required. Traffic shall be maintained at all times. If one -way traffic prevails, uniformed police shall be in attendance at the expense of the Grantee. Reflectorized plastic drums shall be used in the highway work zones; the use of metallic drums is not allowed. Said access shall be graded downward from the edge of the highway at the rate of one (1/4 ") quarter inch per foot to the State Highway Layout Line. PAGE 2 Permit # 2 - 19538 The access is to extend from Station 34 +70 to Station 34 +86 at the 1918 State Highway Layout Line, flaring to extend from Station 34 +60 to Station 34 +96 at the existing edge of the paved highway. Within three (3) months after the start of construction, the access shall be surfaced with Bituminous Concrete Type I (Hot - Mix) to the limits as shown on the attached sketch and shall have a six (6 ") inch foundation of compacted gravel and shall butt and not overlap the existing edge of the hardened surface. That portion of the access within the State Highway shall be maintained by the Grantee at their expense and to the satisfaction of the Engineer. THE GRANTEE AND /OR SUBSEQUENT OWNERS ARE ADVISED THAT THIS PERMIT IS INTENDED TO GRANT ACCESS AND EGRESS FOR THE ONE RESIDENCE ONLY. ANY FURTHER DEVELOPMENT, EXPANSION, NEW BUSINESS, OR CHANGE IN USE SHALL REQUIRE THE FILING OF A NEW APPLICATION FOR PERMIT AND, IF NECESSARY, AN ENVIRONMENTAL NOTIFICATION FORM, PROPERLY FILED WITH THE EXECUTIVE OFFICE OF ENVIRONMENTAL AFFAIRS, MEPA UNIT ANY EXPANSION, NEW DEVELOPMENT OR CHANGE IN USE SHALL BE SUBJECT TO THE "MASSACHUSETTS ENVIRONMENTAL POLICY ACT, CHAPTER 30, SECTIONS 61 AND 62A -H ", The finished construction shall conform to the attached sketch, as submitted by the Massachusetts Department of Public Works. The Grantee's property shall be graded in such a matter that storm water or other drainage shall not flow directly onto the State Highway Layout. Any ponding of water which may occur in this area as a result of the work herein described shall be the responsibility of the Grantee. The existing gutter grade and line shall not be changed. The highway surface shall not be disturbed. No signs shall be located within or overhang the State Highway Layout line. Any disturbed area shall be replaced in kind, e.g., loamed, fertilized, limed and seeded, bituminous concrete, gravel, etc. If the Engineer deems it necessary, an inspector shall be assigned to the work and the cost of said inspector shall be charged to the Grantee, PAGE 3 Permit % 2 - 19538 Construction material and methods shall conform to the 1988 Massachusetts Specifications for Highways, Bridges and Waterways. Where a snow or ice conditions exists during the progress of this work, the grantee shall keep the highway well sanded to a point not less than two hundred (200') feet beyond the limits of the barriers and signs. No tracked vehicles will be allowed on the highway surface without a protective mat. Adequate lights, signs and barriers shall be provided by the Grantee. All utility companies whose services are located within or adjacent to the proposed installation areas shall be notified in writing of the proposed installation at least 48 hours prior to the start of any excavation in said areas. this is independent of required Dig Safe notification. No trees shall be removed nor shall any roots be cut. The Grantee shall save blameless the Commonwealth of Massachusetts, its Department of Public Works, and /or any of its assigns from any liability claims or suits as a result of the work involved in or covered by the issuance of this permit. A copy of this Permit must be on the job site at all times for inspection. Failure to have this Permit available at such site will result in suspension of the rights granted by the Permit. The Grantee's attention is directed to the requirement of Chapter 228 of the Acts of 1972 concerning excavation. (SEE OTHER SIDE FOR ADDITIONAL CONDITIONS) All construction within the State Highway Layout shall be completed within 12 months of the issuance of this permit.
