! At a meeting held on October 15, 1986, the Zoning Board of Appeals of
j' of the City of Northampton voted unanimously to jLant the Finding request of
John F. & Evelyn C. Fortier, P.O. Box 376, Florence, MA, for the purpose of
ii changing the use in a pre-existing nonconforming structure from a bus garage/
repair facility to a retail establishment at property located at 59 5ervice-
11, Service-
11, Center Road, Northampton, MA (SI Zone). Present and voting were: Chairman
Robert C. Buscher, William Brandt and Peter Laband.
The Findings were as follows:
P. Laband found that in rendering a decision for a Finding, the Board
must look to Section 10.10 of the Zoning Ordinance for guidance, and
as such, found that the use is listed in the Zoning Ordinance; that the
requested use bears a positive relationship to the public convenience,
as the area is changing from industrial uses; that traffic congestion
would be lessened with a retail use; that the requested use will have
no effect on municipal services; that the general welfare will not be
impaired. Referring to Section 9.3 (B & E), he found that the alteration
of use in a nonconforming structure will not be substantially more
detrimental than the existing use to the neighborhood.
W. Brandt concurred, finding that the nature of the area has changed
since the bus facility was constructed, and the requested use will be
an improvement to the neighborhood and the surrounding new buildings.
R. Buscher also concurred.
The following condition shall apply:
The use allowed shall be a retail establishment/general merchandise
of less than 10,000 sq. ft. , as listed in Section 5.2, Paragraph 2.A. ,
Page 5.8 of the Northampton Zoning Ordinance.
