I have recently received complaints about the stormwater management facility (detention pond)
at the Yankee Hill Condominiums in Northampton. Apparently this facility has filled in with
sediments because of lack of proper maintenance. As such, it cannot operate as it was designed
and it is not providing the retention and control of stormwater runoff that is essential.
Property owners are required to annually maintain these structures so that they perform at the
level intended and prevent both on and off -site damage due to stormwater runoff. Maintenance
generally entails inspection and dredging, by a qualified person, to remove the sands and other
solids that collect over time. If maintenance of the Yankee Hill Condominium pond has been
deferred for a number of years, there may be several other functional items that need inspection
and improvement.
Since these improvements generally take place in late spring or summer, there should be plenty
of time for the Yankee Hill Condominium Association to hire the appropriate professionals to
conduct this maintenance.
I would be happy to answer any questions you might have regarding these requirements.
Additionally, please let me know the intended timeline for meeting the maintenance
requirements at this property.

I have numbered my response to your questions as listed in your request for information. I hope
that this answers your questions. Please note, that much of the information for the files is non-
existent, therefore it is harder to answer your inquiry.
Date of 10 year expiration of ZBA permit issued for Yankee Hill?
A. The permit issued by the ZBA had to be exercised within two years of the date of
it's issuance. The original permit was issued in 1972, then litigated and amended as
a result of the litigation. The date of the amendment was February 27, 1985. This
is the date that starts the two year time period.
B. I believe that the "ten year" time period to which you refer, is based upon the
Building Department's ability to require the property owner to correct violations
after a permit was issued in error, issued incorrectly, or had been constructed
incorrectly.
2. Was ZBA approval given for the May 13, 1986 Building Permit?
A. There is no record of any correspondence in our files, that states approval was
given by the ZBA. I am not sure why it was needed, unless the plan was changed
and required an amended decision. None was requested, per our files.
3. What is controlled construction under Article 127 of the State Building Code?
A. Controlled construction under Article 127 of the State Building Code is when an
architect is responsible to "sign-off' on all aspects of a project, that require
inspections under the Building Code. The Building Department stated that
although the architect is responsible, their department still makes inspections.
Whether this was done during the construction of your site, is not known.

4. Was the Zoning Board of Appeals decision required to be filed at the Registry of
Deeds, before a Building Permit was issued?
A. When the decision was originally granted, in 1972, MGL Ch 40A was in existence
in some form or another. I believe that Ch 808 governed development and if a
municipality had a Zoning Ordinance in effect, it regulated the permits issued.
Section 11 of MGL Ch 40A states that:
"No Variance or Special Permit or any extension, modification or renewal
thereof, shall take effect until a copy of the decision bearing the
certification of the city or town clerk that twenty days have elapsed after
the decision has been filed in the office of the city or town clerk and no
appeal has been filed or if such appeal has been filed, that it has been
dismissed or denied... is recorded in the registry of deeds for the county
and district in which the land is located and indexed in the grantor index
under the name of the owner of record or is recorded and noted on the
owner's certificate of title."
It appears from the above - quoted language, that the permit was required to be recorded at
the Registry of Deeds. When the permit was issued, the Zoning Ordinance did not state
that a permit had to be exercised within any time frame, therefore, the state law dictated
that the permit must be exercised within two years of it's issuance.
B. When the decision was amended, in 1985, it appears that MGL Ch 40A also
required that a Special Permit be recorded at the Registry of Deeds. However, our
city's Zoning Ordinance of 1985 did not state a specific time period by which
permits had to be exercised, therefore, the state law would dictate that it had to be
exercised within two years.

At your request, we have visited the development and reviewed our project files for information
related to the Yankee Hill Condominiums storm water management system.
This system was designed by Almer Huntley, Jr. and Associates, Inc. and construction completed
in 1987. A drainage system composed of catch basins for the surface drainage and footing drains
for the buildings discharges easterly to the detention pond. The detention pond was designed to
provide storm water management control for the ten, twenty -five and one hundred year storms.
The discharge from the detention pond flows through a 10" pipe into a riprap swale leading to a
culvert under Evergreen Road..., _
On March 14, 2002, I inspected the detention pond, outlet pipes and catch basins within the
parking lots. The detention pond basin and embankments were covered with vegetation, small
shrubbery and trees. The bottom of the basin appears to support some wetland species. The
main inlet and outlet of the pond were found to be clear with a small distinct channel from the
inlet to the outlet. The end of the discharge pipe discharges to a riprap channel and then into a
12" drain under Evergreen Road. The riprap channel has filled in with debris and is barely
distinguishable from the surroundings. I also inspected several of the catch basins within the
parking lot and found a substantial amount of debris within the sumps of the structures.
One of the comments from the City of Northampton, Planning and Development, pertained to the
filling of the facility. This is difficult to ascertain from a field visit without the aid of a
topographic survey. The as -built plans for the project, dated in July 14, 1987, do not provide
topographic data. They do indicate the pond was constructed in substantial conformance with
the design plans.
Given the recent lack of significant precipitation it was not possible to determine if the pond is
functioning as designed.. The design of the outlet control for the pond will pass smaller storms
with little to no detention of storm water. The mitigating effects of the pond only become
apparent with a larger storm such as the ten -year storm.

It appears from the site visit that very little if any maintenance has been performed since
construction was completed. There are several larger trees (4" caliper) that have grown within
the pond and embankments. We do not see a benefit to removing this larger vegetation as it
provides some screening of the pond and development, occupies very little storage volume, and
offers some stabilization of the embankments. At this time we would recommend the following
maintenance items be addressed:
1. Removal of all shrubbery, vines and briars.
2. Mowing of the basin and embankments with a hand trimmer.
3. Cleaning of the basin to remove all debris.
4. Clean and rebuild the outlet channel from the outlet pipe of the pond to the culvert under
Evergreen road.
5. Place new riprap in the channel.
6. Remove all sediments from the catch basins within the parking lots.
7. Inspect and clean all inlet pipes into the pond.
8. Inspect and clean outlet pipe of pond.
9. Conservation seed any barren areas.
As part of an ongoing annual maintenance plan the following should be addressed:
1. Inspection of pond at least once annually.
2. Inspections conducted during a storm to determine if the basin if functioning as intended.
3. Outlet structure should be inspected for evidence of clogging or excessive outflow release
velocities.
4. Pond should be inspected for evidence of subsidence, erosion, cracking or tree growth on
the embankments.
5. Inspection of emergency spillway for damage.
6. Sediment accumulation around the outlet.
7. Inadequacy of the inlet/outlet channel erosion control measures.
8. Any repairs should be made immediately.
9. The upper- stage, side slopes, embankment and emergency spillway should be mowed at
least twice per year.
10. Trash and debris should also be removed coincident with the mowing.
11. Sediment should be removed from the basin as necessary and at least once every five
years.

12" drain under Evergreen Road. The riprap channel has filled in with debris and is barely -
distinguishable from the surroundings. I also inspected several of the catch basins within the
parking lot and found a substantial amount of debris within the sumps of the structures.
One of the comments from the City of Northampton, Planning and Development, pertained to the
filling of the facility. This is difficult to ascertain from a field visit without the aid of a
topographic survey. The as-built plans for the project, dated in July 14, 1987, do not provide
topographic data. They do indicate the pond was constructed in substantial conformance with
the design plans.
Given the recent lack of significant precipitation it was not possible to determine if the pond is
functioning as designed.. The design of the outlet control for the pond will pass smaller storms
with little to no detention of storm water. The mitigating effects of the pond only become
apparent with a larger storm such as the ten -year storm.

It appears from the site visit that very little if any maintenance h c been performed sm ecAPE ARCHITECTS
construction was completed. There are several larger trees (4" caliper) that have grown within
the pond and embankments. We do not see a benefit to removing this larger vegetation as it
provides some screening of the pond and development, occupies very little storage volume, and
offers some stabilization of the embankments. At this time we would recommend the following
maintenance items be addressed:
1. Removal of all shrubbery, vines and briars.
2. Mowing of the basin and embankments with a hand trimmer.
3. Cleaning of the basin to remove all debris.
4. Clean and rebuild the outlet channel from the outlet pipe of the pond to the culvert under
Evergreen road.
5. Place new riprap in the channel.
6. Remove all sediments from the catch basins within the parking lots.
7. Inspect and clean all inlet pipes into the pond.
8. Inspect and clean outlet pipe of pond.
9. Conservation seed any barren areas.
As part of an ongoing annual maintenance plan the following should be addressed:
1. Inspection of pond at least once annually.
2. Inspections conducted during a storm to determine if the basin if functioning as intended.
3. Outlet structure should be inspected for evidence of clogging or excessive outflow release
velocities.
4. Pond should be inspected for evidence of subsidence, erosion, cracking or tree growth on
the embankments.
5. Inspection of emergency spillway for damage.
6. Sediment accumulation around the outlet.
7. Inadequacy of the inlet/outlet channel erosion control measures.
8. Any repairs should be made immediately.
9. The upper- stage, side slopes, embankment and emergency spillway should be mowed at
least twice per year.
10. Trash and debris should also be removed coincident with the mowing.
11. Sediment should be removed from the basin as necessary and at least once every five
years.

Dear Ms. Harlow:
I have recently received complaints about the stormwater management facility (detention pond)
at the Yankee Hill Condominiums in Northampton. Apparently this facility has filled in with
sediments because of lack of proper maintenance. As such, it cannot operate as it was designed
and it is not providing the retention and control of stormwater runoff that is essential.
Property owners are required to annually maintain these structures so that they perform at the
level intended and prevent both on and off -site damage due to stormwater runoff. Maintenance
generally entails inspection and dredging, by a qualified person, to remove the sands and other
solids that collect over time. If maintenance of the Yankee Hill Condominium pond has been
deferred for a number of years, there may be several other functional items that need inspection
and improvement.
Since these improvements generally take place in late spring or summer, there should be plenty
of time for the Yankee Hill Condominium Association to hire the appropriate professionals to
conduct this maintenance.
I would be happy to answer any questions you might have regarding these requirements.
Additionally, please let me know the intended timeline for meeting the maintenance
requirements at this property.

I have numbered my response to your questions as listed in your request for information. I hope
that this answers your questions. Please note, that much of the information for the files is non-
existent, therefore it is harder to answer your inquiry.
Date of 10 year expiration of ZBA permit issued for Yankee Hill?
A. The permit issued by the ZBA had to be exercised within two years of the date of
it's issuance. The original permit was issued in 1972, then litigated and amended as
a result of the litigation. The date of the amendment was February 27, 1985. This
is the date that starts the two year time period.
B. I believe that the "ten year" time period to which you refer, is based upon the
Building Department's ability to require the property owner to correct violations
after a permit was issued in error, issued incorrectly, or had been constructed
incorrectly.
2. Was ZBA approval given for the May 13, 1986 Building Permit?
A. There is no record of any correspondence in our files, that states approval was
given by the ZBA. I am not sure why it was needed, unless the plan was changed
and required an amended decision. None was requested, per our files.
3. What is controlled construction under Article 127 of the State Building Code?
A. Controlled construction under Article 127 of the State Building Code is when an
architect is responsible to "sign -off' on all aspects of a project, that require
inspections under the Building Code. The Building Department stated that
although the architect is responsible, their department still makes inspections.
Whether this was done during the construction of your site, is not known.

4. Was the Zoning Board of Appeals decision required to be filed at the Registry of
Deeds, before a Building Permit was issued?
A. When the decision was originally granted, in 1972, MGL Ch 40A was in existence
in some form or another. I believe that Ch 808 governed development and if a
municipality had a Zoning Ordinance in effect, it regulated the permits issued.
Section 11 of MGL Ch 40A states that:
"No Variance or Special Permit or any extension, modification or renewal
thereof, shall take effect until a copy of the decision bearing the
certification of the city or town clerk that twenty days have elapsed after
the decision has been filed in the office of the city or town clerk and no
appeal has been filed or if such appeal has been filed, that it has been
dismissed or denied... is recorded in the registry of deeds for the county
and district in which the land is located and indexed in the grantor index
under the name of the owner of record or is recorded and noted on the
owner's certificate of title."
It appears from the above - quoted language, that the permit was required to be recorded at
the Registry of Deeds. When the permit was issued, the Zoning Ordinance did not state
that a permit had to be exercised within any time frame, therefore, the state law dictated
that the permit must be exercised within two years of it's issuance.
B. When the decision was amended, in 1985, it appears that MGL Ch 40A also
required that a Special Permit be recorded at the Registry of Deeds. However, our
city's Zoning Ordinance of 1985 did not state a specific time period by which
permits had to be exercised, therefore, the state law would dictate that it had to be
exercised within two years.
DECISION OF
ZONING BOARD OF APPEALS
The Northampton Zoning Board of Appeals of the City of Northampton met
on February 27, 1985 and voted unanimously to amend the Special Permit
granted to San -land Corp., et.al., which was filed in the Office of the
City Clerk on July 12, 1972. Present and voting were: Chairman Robert C.
Buscher, William Brandt and Charles Maguire.
Condition #1 shall read as follows:
1. The proposed complex shall have at least 3,000 square
feet of land area for each dwelling unit.
