At its meeti.n; on 4iednesday, September b, 1978 the Zoning
Board of Appeals for the City of Northampton voted to deny the
petition of Kenneth and Stephanie Vile for a variance to operate a
beauty shop in a suburban residential zone.
based upon evidence presented to the board, the Board made the
following findings in regard to the variance:
1. The property in its present form has no special conditions
which affect it but not other properties in the district.
2. The literal enforcement of the Zoning Ordinance does not
create a hardship to the owners in that their being forced
to vacate a downtown location was not a result of the
Zoning Ordinance and that although they might be having
trouble maintaining, the property, this would not necessar—
ily be true of another owner.
3. Tho proposed use will not be detrimental to the public
good as this kind of business would not create undue tra£'—
fie congestion or noise.
4. Phe proposed use would nullify or dero;;ate the intent of
the 3oning Ordinance becauc - e it would allow a business in
a district zoned for residential use and becauoe no ;;pec—
ial condition affectin the property hag been shown.
