As I discussed with Jeff Squires at Berkshire Design, there are two conditions of this permit that are required prior to issuance of a building permit for the Hilton Garden Inn (please see the permit for full description of the conditions): 1. Finalized, executed, and recorded Stormwater Operation, Maintenance, and Inspection Agreement. This agreement must clearly identify the stormwater structures that will be maintained by the property owner. Due to continuing discussions regarding easements defining ownership of storm drain lines and structures on City property and the time frame needed to complete these documents, it makes sense to extend the completion of Operation and Maintenance Agreement until the easement documents are in place. The owner needs to formally request that the timing of this condition be extended and the DPW will issue confirmation that the condition must be met prior to issuance of a certificate of occupancy for the hotel. 2. Copies of the EPA NPDES Construction Permit Notice of Intent (NOI) and Stormwater Pollution Prevention Plan (SWPPP) for the project submitted and approved by the DPW prior to issuance of a building permit. If construction of the proposed stormwater system has not started within five years of the issue date of this permit, then the permit will expire and a new permit will be required. Construction is defined as clearing, grading, excavation, filling, and installation of drainage structures on the lots specified in this permit. Specific Permit Conditions: 1. Prior to issuance of a Building Permit, the applicant shall record an executed Stormwater Operation, Maintenance, and Inspection Agreement that is binding on all subsequent owners of land served by the private stormwater management facility by recording it in the land records of the Registry of Deeds.
