Upon the recommendation of the Mayor Mary Clare Higgins, the Community Preservation

WHEREAS, the Northampton Open Space and Recreation Plan and the Sustainable
Northampton Comprehensive Plan recommend expanding recreation opportunities,
preserving farmland, and acquiring riparian land along the Mill River; and
WHEREAS, the Agriculture, Recreation, and Conservation Commissions and the Bean Farm
Task Force recommend the permanent preservation of the Bean and Allard Farms;
and
WHEREAS, on December 18, 2009, City Council created a Bean Farm Task Force and created a
public process for making recommendations on the ultimate uses of the Bean Farm,
with said process now being used to hear from the community and make
recommendations on both the Bean Farm and the Allard Farm; and
WHEREAS, the Bean/Allard Task Force recommendations will be the basis for the City's
negotiation with the Trust-for Public Land, who is the lead agency working to
Preserve this property; and .
WHEREAS, no acquisitions will actually take place before Bean/Allard Farm Task Force
recommendations are made on those acquisitions; and
WHEREAS, the project uses Community Preservation funds effectively to leverage other grant
and community funding; and
WHEREAS, no athletic fields will be developed on the property until there is funding to develop
such fields and a plan for maintaining the fields if city maintenance funding is
limited or unavailable;
_ NOW, THEREFORE BE IT ORDERED,
That City Council appropriates $990,000 for the acquisition of fee or less than fee interests for
all or a portion of the Bean and Allard Farms;
And that to meet this appropriation $80,000 is appropriated from CPA Budgeted Reserve
(account #2344930- 3599300);
And that the City Treasurer with the approval of the . Mayor is authorized to borrow $910,000,
over 15 years, under G.L. c.44B, § 11 or any other enabling authority, and the debt repayment is
i appropriated fiom the CPA Budgeted Reserve (account #2344930- 3599300); i
And that the Conservation Commission and Recreation Commission are authorized to contract
for and expend any federal, state, or other aid available for this project, including but not limited
to:
• Any grant from the Division of Conservation Services of the Executive Office of
Environmental Affairs, under the Self -Help Act, Section 11 of Chapter 132A of the
General Laws;
• Any Federal Land and Water Conservation Fund grants;
• Any Agriculture Preservation Restriction grants
And that the City of Northampton, acting through its Recreation Commission and Conservation
Commission, is authorized to purchase or otherwise acquire for conservation, passive recreation,
and active recreation purposes, as provided by MGL Chapter 40, Section 8C, MGL Chapter 45,
Section 45, and other applicable sections of General Laws, any fee, easement, and any
conservation restriction and/or agriculture preservation restriction as defined in MGL Chapter
184, Section 31of the General Laws or any other interest in the above land and any immediately
adjoining land and consistent with Article 97 of the amendments to the Massachusetts
Constitution and the Community Preservation Act;
And that City Council approves such conservation and agriculture preservation restrictions.

WHEREAS, the funds contribute to the purchase of a 30 -acre open space parcel on
Turkey Hill Road.
WHEREAS, the parcel extends existing conservation land and abuts additional land
being preserved in Westhampton.
WHEREAS, this is a strategically important location
WHEREAS, the purchase will allo A7 discontinuance of approximately 1/2 mile of Turkey
Hill Road, which will eliminate cost to the city and a threat from possible
development.
WHEREAS, the project meets the goals of the Northampton Sustainability Plan to
protect open space and provide for passive recreation.
WHEREAS, on November 17, 2010, the Northampton Community Preservation
Committee, voted unanimously to recommend $85,720 in Coirunu.nity
Preservation Act funds be used to support this project.
NOW, THEREFORE BE IT ORDERED,
That $85,720 be appropriated from Community Preservation Act funding to the Turkey
Hill Land Acquisition. And, that the grantee meets the conditions approved by the
Con Preservation Committee, the Mayor, and City Council.

WHEREAS, the project saves resources that would otherwise be threatened
WHEREAS, the project leverages funds effectively
WHEREAS, the project contributes to a goal of the Northampton Sustainability Plan to

Committee, voted unanimously to recommend $60,000 in Community
