or non - renewal of permits in the event that the permit holder was
not a licensed advertiser.
5. Any cancellation or non - renewal of permits based upon
the absence of a license violates the First Amendment to the
United States Constitution and the Massachusetts Bill of Rights.
6. The signs were lawfully in existence on December 31,
1971 notwithstanding any absence of a permit.
7. The signs could not be ordered removed without the
payment of compensation and, therefore, were lawfully in
existence on December 31, 1971 and at all other relevant times.
The material issues of fact that are in dispute and which
require a hearing before the Board relate to whether or not the
signs were lawfully in existence on December 31, 1971, and what
the proper interpretation is of the agreement between the DPW and
the federal government.
The relief requested by Messrs Dulong and Labbee is a
determination that the signs are in compliance with Chapter 93D
and the agreements between the DPW and the federal government
made pursuant to Chapter 93D.

Q Labbee hereby request a hearing before the Board on the above-
, referenced preliminary determination made by you on March 6, 1991
which determination was received on March 8, 1991.
The reasons why the preliminary � Y P Y determination should not
become final include the following:
1. The preliminary determination focuses on the third
sentence of section 2 of the agreement dated December 31, 1971 as
amended by the addendum dated September 25, 1980. It ignores the
second sentence which limits the application of the agreement to
signs which were erected after December 31, 1971. Because the
signs at issue were erected before that date, the agreement has
no application to them.
2. The preliminary determination focuses on the one face
of this sign which was not advertising the Colonial Statler
Hilton hotel in 1969. The other face did advertise the services
of the permit holder and, therefore, was lawfully in existence on
December 31, 1971.
3. Neither of the permits which were to the
Colonial Hilton on or about July 16, 1968 restricted the use of
these signs to copy advertising the permit holder.
4. The regulations of the Outdoor Advertising Board in
effect as of 1969 did not require or authorize the cancellation
