Prior to issuance of a certificate of occupancy for the first barn, an as-built plan, stamped by a lighting engineer, for the lighting shall be submitted showing substantial compliance with the approved plan and showing no more than 2 foot-candles at the property line along cross-path road. FINDINGS: The Planning Board voted to approve the site plan for the construction of three replacement barns of 18,000 square feet each and associated site improvements at the Fair based upon the application and the following materials submitted with the application. 1."Three County Fair Grounds Phase 1 2010", dated Sept 6, 2010 rev. 10/6/10. The Site Plan for more than 5,000 square feet of construction was approved subsequent to the Zoning Board of Appeals making a FINDING for an alteration of a pre-existing non-conforming Fair use. In accordance with Chapter 350 section 11 and 12.(site plan and lighting) 1) The requested use protects adjoining premises against seriously detrimental uses. This use is allowed 100+ year old fair pre-dates zoning. Drainage will be reconfigured on site to improve existing conditions, substandard lighting will be replaced with more efficient dark-sky compliant lights. 2) The requested use at the site will promote the convenience and safety of vehicular and pedestrian movement within the site by relocating barns and reconfiguring paths between show rings and the barns and creating lit, landscaped paths. It will have no effect on adjacent streets as the underlying use is not changing with the new site configuration. (3)The requested use will promote a harmonious relationship of structures and open spaces to the natural landscape, existing buildings and other community assets in the area. New trees and landscaped areas internal to the site will enhance the site. Barns will be removed from the property edge and reconstructed toward the center of the existing site, thus improving the setbacks and buffers at the edge. A stormwater permit has been obtained. All utility improvements are consistent with those allowed by Department of Public Works. (5) The requested use meets any special regulations set forth in this chapter including section lighting, stormwater management. The Board approved higher light levels at the show ring, pedestrian paths and multi-use area to create safer function for horses and users during limited times during the year. The higher light levels increase efficiency from existing conditions and contain full-cut off fixtures. (6) The requested use bears a positive relationship to the public convenience or welfare. The continued use will not unduly impair the integrity of character of the district or adjoining zones, nor be detrimental to the health, morals, or general welfare. The reconstruction of the barns will enable the Fair to maintain the Morgan Horse Show at the site, which has historically been a mainstay of function at the site.
