August P,7 19 54
The petition was presented to this Board by Philip and Mae villone of
Grove Hills, Leeds requesting a Variance in the sonind ord3fta"e to erect
a eealtiple dwelling unit on the West side of villona Drive After due
Public notice a hearing was heard In the Comall poons on Dust 19th
195 The entire proceeding was taken by stenographic notes. A ing
for they peetitioneers Philip and Mae vlllons was Attorney Robert T Doyle.
ApPearing against the Petitioners were a number of tooplee who live
in the n6l.ghborhood of the proposed now dwelling,
Those who were apn**ring in favor or the petitioners were given the
oPportnni.ty to speak first. The only person appearing In fervor of the
Petitioners was their attorney, Robert T, Doyle. Mr. Doyle 9814 that it
would be a great benefit to the City of Northampton to have this tyre of
dwelling up there because there, was a need, He introduced a letter tr't?m a
Realtor in the City that the realtor had a demand for this tpp+e of dwelling.
Mr. Doyle was asked by the City Solicitor what the hordrehip wozild . bee
to the Petitioners if the petitioft was not grated an v'arl'etn60 xr Doyle
stated that there was no unusual hardship except that it Is more Oraextle&l
to use multiple dwellings than single, He was asked could not the petitioners
use single type dwellings? sOld of 00t Of single houses could be used
but it would be much better to use multiple,
Against the POtitiOn there a-pear od several people from the area. Mr.
Richard Pickett, who lives and owner 9 villone Drivel directly across the
street from the proposed structures. 14r. Pickett Oppose OW, v►arlo a In the
zoning ordinance because the purnosEe of the zoning ordinance was to keep
a certain area with a certain type of dwelling and if you prreelt a vari-
ance in the zoning ordinance so that a person can change a single into a
multiple than you Haight as well throw out the zoning ordinonee entirol.y.
He objected as a person who bought a home from Mr. Villone with the, under-
standing that the area would be single dwelling area and hhe objected any
change in this because as he pointed out that abut 1 58 automobiles weld
be brought into that area and he would be o sod to that. In his lease
there is a covenant that the property would not be used for anything but
a single dwelling.
Mr. Parsons who lives and owns 5 Vi.11.one► Drive stateEd that he op-
Mr. hal.inowski who spoke for his father 'testified i that the eows
will not now drink the brook water on his property because of the sewerage
that comes on the t k .. 4 flows down Into brook No A i .: t 9
any further dwe12ings until a sewerage plank was to be peat into effect.
Dr, Branch who its on Vil.lones Drive objected to any obande in the
variance for the seasons stated by the other objectors and the fact that he
was worrier about the ears that would come as a result of the new dwelling
M►
structure. He rented the home beeause he wanted to get eawaay from Sul.ti.
dwelling apartments havAng lived in Wash ngton D. Co in multiple dwelling
apartments for some time. No rented on Villom Drive beasuse of being in
a single dwelling area and her believed this would be so.

Mr. Doyle was asked how the sewerage of these multiple dwellings
would be taken care of. .A reply to this was rather indefinite. He
stated that they would not use septic tanks. He was asked wh6ther they
had any written statement from Mr. Sterling that he would allow the new
dwelling to tap into the Mill River. He said that no written statement
was required and none stated that any written authorization was given
by Mr. Sterling. Mrs. Villone said that they had talked with Mr. Sterling
and he said it would be okay.
The Board's findings and facts on this petition are as follows:
Mr. Ralph Leveille: Would like to go on record as being
in favor of granting a variance for the following reasons:
That the area surrounding this tract is zoned as "B"
which allows this type of construction. That by granting this variance
it will encourage the most appropriate use of this area and that it will
be a great benefit to the City without injuring the neighborhood. Also
that their is a great demand for this type of housing in the City.
Mr. Milton I. Tarshus: In favor,of rejecting this petition
on the following facts: The request by the petitioners is not for a small
variance or changing a small part of the property. He is actually asking
for a change in the zoning of five- sixths(5 /6) of the property. The
attorney for the petition stated that the only hardship to the Villones
was in fact a financial hardship. The petitioner could make better use
of his property be& constructing multiple dwellings than if he. restricted
to single houses as he did before. The petitioner admitted that he could
use single dwellings but the City of Northampton would make more out of it
if he used multiple dwellings. I find that the neighbors who came to the
.
` wo
.. Z} ..
hearing opposed the granting of this petition. Objected to the ehange
for several reasons. They bought their property with the understanding
that it would be s single dwelling unit in a residential area. Opposed
to it that the petitioner was seeking a variance from class A into B.
On the above findings I reject the request for a variance. The extent
of the variance requested by the petitioner is so great that in my
opinion is a matter far. the Planning Board not for the opeals Board.
Mr. Berube Chairman of the Appeals Boards
"I am opposed to this petition for two reasons: I find it a Fact
that it is not an unusual hardhhip case. The land could be used for
better purposes as aG single dwelling unit. I also Find it a fact that
the variance they are asking for is toogreat. T also believe that this
is a matter for the Planning Boarder
WHEREFORE. it is 011DERED, ADJ' .D AND DECRF3.,D that the petition of
1hilip and Mae Villone, Grove Hill, Leeds be denied because of the
findings and Facts started above.
