C4ilds 6205 Hampton Gardens Northampton, MA . 01060 HE: East Center. Street and Haydenville Road, Northampton. I visited the site .August 6, 1979 about 10:30 AM. My observations on the following numbered conditions in the order of 4/9/76: 12. Condition not met. Area not stabilized. Bare gravel fill. Construction debris used for rip -rap. ( see photo sttached). a. Construction debris. b. Not ascertainable`. d. Not done, bare gravel. 13. House not commenced. 14. Some soil fill, whether in foundation location or not cannot be ascertained from information available at this site visit*. 15. There appears none. 16. Not ascertainable from information available at this site visit*. 17• Raw fill, unseeded, into wetlands. 18. Not commenced. 19. Not ascertainable *. 20. Bare gravel, not seeded, mulched, covered or protected. No site plan was included in the packet I received from the Planning Office so location and intended conidition of the house construction site could not be determined. A lot for sale sign was nailed to a tree on the site. The DEQE sign required under Ch. 141 S. 40 was not visible. RECODMI ND.ATION: The owner should be notified of the failure to comply with the conditions. .Another site visit may be necessary to determine the conditions relating to the construction area. The owner should be notified that an extension or a new application is necessary before further activity can be continued on the site. RE: NOTICE OF INTENT AND PLANS DATED: DATE OF PUBLIC HEARING 3/29/76 PROJECT LOCATION: East Center St. & Haydenville Rd. CERT. MAIL NO: Northampton, Mass. 910339 DATE'OF RECEIPT BY CONSERVATION COMMISSION: 3/10/76 Pursuant to the authority of G. L. c.131 s.40, the NORTHAMPTON CONSERVATION COMMISSION has considered your notice of intent and plans submitted therewith, and has determined that the area on which the proposed work is to be done is significant to one or more of the interests described in the said act. The NORTHAMPTON CONSERVATION COMMISSION hereby orders that the following conditions are necessary and all work must be performed in strict conformance therewith: CONDITIONS 1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this order. 2. This order does not grant -any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3. This order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state,, or local statutes, ordinances, by -laws and /or regulations. 4. The work authorized hereunder shall be completed within one (1) year from the date of this order. The order may be extended by the issuing authority for one or more additional one -year periods upon application to the said issuing authority at least thirty days prior to the expiration date of the order or its extension. 5. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or debris, including, without limiting the generality of the foregoing, lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, -tires, ashes, refrigerators, motor vehicles or parts of any of the foregoing. 6. No work may be commenced until all appeal periods have elapsed from the order of the Conservation Commission or from a final order by tb Department of Environmental Quality Engineering. 1 CONDITI COIJTTIvUED �, PAGE 2 of 4 F,. NO. 246 -21 7. No work shall be undertaken until the final Order, with respect to the proposed project, has been recorded in the Registry of Deeds for the district in which the land is located. Copy to be furnished to issuer of this Order showing book and page. 8. Upon completion of the work described herein, the applicant shall forthwith request, in writing, that a Certificate of Compliance be issued stating that the work has been satisfactorily completed. 9. A sign shall be displayed at the site not less than two square feet or more than three square feet bearing the words, "Massachusetts Department of Environmental Quality Engineering, File Number 246 -21 ". 10. Where the Debt. of Environmental Quality Engineering is requested to make a determination and to issue a superseding order, the Conservation Commission shall be a party to all agency proceedings and hearings before the Department of Environmental Quality Engineering. 11. The work shall conform to the following described plans and additional_ conditions: Sketch plans submitted with Notice of Intent and detail of culvert submitted at public hearing, except as modified by the following conditions. 12. No building permit shall be issued, or house construction begun until the area north and west of the existing brook is cleared of debris, regraded, and stabilized to prevent erosion, in accordance with the following specifications, and until the site is inspected and approved in writing by the Conservation Commission. a. All stumps, logs, and other debris shall be removed from the site. b. With approval of Michael L. McKnight, all material deposited on his land shall be removed in order to restore the original drainage patterns, and the drainage shall be stabilized against erosion. c. No slope shall be steeper than 3 horizontal to 1 vertical except in the area adjacent to the existing culvert under Rt. 9 and adjacent to the rip -rap at the ends of the proposed culvert. d. The area shall be loamed, seeded, and mulched or otherwise stabilized to prevent erosion. 13. The basement floor elevation shall not be more than four feet below the level of the closest point on Rt. 9, and shall not be less than two feet above the top of the streambank nearest to the proposed house. 14. Fill for footing and foundation shall be bank run gravel or equivalent and shall be compacted in accordance with the State building Code and to the satisfaction of the building inspector. There shall be no excavation, grading, or equipment traffic in the stream channel except for that minimum necessary for installation of the water service line and culvert. 16. Except as required for installation of culvert, driveway, and parking area, there shall be no further deposition of fill within 5 feet of the original streambank. 17. No slope shall be created steeper than 2:1 without physical control measures for stabilization, such as rip -rap or retaining walls. 1$.
