("Covenantor"), in. accord-with the Decision of the Northampton Planning Board approving•the :.
Definitive Plan of a subdivision, known as The Village at Hospital Hill, Phase One Definitive
Subdivision, Northampton, Massachusetts (Hampshire County) (the `-`Definitive Subdivision Plan =
Approval") recorded in the Hampshire Registry of,deeds in Plan Book 202, Page 75, recorded a ~ .

Beals and Thomas, Inc., 144 Turnpike Road, Southborough; MA 01772 recorded with
Hampshire CountyRegistry ofDeeds in Plan Book-202, Page 75 (the "Plan"). Lots 1-11 are
shown_on the Plan and are. subject to the. Covenant.
WHEREAS, on February 26; 2009, the NorthamptonPlanning Board.issued a decision of
Subdivision Amendment Approval amending the Plans to eliminate Lots 1-11 from the
'subdivision as a result of the elimination of South Campus Road and granting the request for
.partial release of the Covenant with. respect to Lots 1-11 based upon the exclusion of Lots 1-11 ~
from the subdivision that is the subject of the Plans and the Definitive Subdivision Approval. -
NOW THEREFORE, PLANNING BOARD OF THE CITY.OF NORTHAMPTON,
MASSACHUSETTS, for consideration paid, hereby releases Lots 1-11 from the Covenant.
